3. Release of Liability
To the fullest extent permitted by law, the customer agrees to release, discharge, and hold harmless Dumpster Dogs, Mann Hauling LLC, and their respective owners, employees, agents, contractors, and representatives from any and all claims, liabilities, damages, losses, costs, or expenses arising out of or related to the rental, delivery, placement, use, loading, presence, or removal of the dumpster, except to the extent caused by Dumpster Dogs’ gross negligence or willful misconduct.

- Landscaping, lawns, and vegetation
- Underground utilities, septic systems, or irrigation lines
- Overhead lines, structures, or fixtures
The customer acknowledges that dumpsters may weigh several thousand pounds and that surface damage is a known and unavoidable risk associated with dumpster placement.
Dumpster Dogs may provide roller pads upon request to help minimize damage; however, no guarantee is made that pads will prevent damage. The customer waives any and all claims for property damage resulting from normal and customary delivery, placement, use, and removal of the dumpster, except to the extent caused by Dumpster Dogs’ gross negligence or willful misconduct.
The customer represents that they have legal authority to authorize placement of the dumpster at the delivery location.
5. Dumpster Use & Prohibited Activities

- No overfilling: debris must not exceed the top edge/top rail of the dumpster.
- No hazardous or prohibited materials.
- Do not move the dumpster after placement.
- Do not climb on, into, or around the dumpster.
- Do not allow children, unauthorized persons, guests, tenants, contractors, or third parties to climb on, enter, or misuse the dumpster.
- Customer is responsible for preventing unauthorized or third-party use of the dumpster.
The customer is solely responsible for all contents placed in the dumpster, regardless of who placed them there.
6. Prohibited Materials Fees
Prohibited materials include but are not limited to hazardous waste, paint, solvents, oils, batteries, tires, appliances containing refrigerants, liquids, medical waste, asbestos, fuel, propane tanks, chemicals, and any other material prohibited by law, landfill rules, or disposal facility requirements.
If prohibited or hazardous materials are discovered in the dumpster, the customer agrees to pay all costs associated with removal, handling, transportation, special disposal, environmental disposal fees, regulatory penalties, landfill rejection fees, third-party remediation, additional labor, and transportation costs.
Hazardous Material Fee: A minimum charge of $90 per hazardous or prohibited material category discovered in the dumpster will apply in addition to any disposal, transportation, environmental, labor, regulatory, remediation, or third-party handling costs incurred by Dumpster Dogs. Separate hazardous material categories may each result in separate charges.
Dumpster Dogs reserves the right to charge the customer for these costs using the payment method on file.
6a. Contamination, Cleanup, Hazardous Materials & Environmental Responsibility
This section governs all forms of contamination, spillage, residue, leakage, environmental damage, and hazardous material exposure caused, contributed to, or left in the dumpster by the customer, the customer's agents, contractors, guests, tenants, invitees, or any third party who accessed the dumpster during the rental period.
Prohibited liquids and contamination sources include, but are not limited to: paint (latex, oil-based, or industrial), paint thinner, stain, varnish, lacquer, motor oil, hydraulic fluid, transmission fluid, gasoline, diesel, kerosene, propane, lighter fluid, antifreeze, brake fluid, solvents, degreasers, acids, bases, pool chemicals, pesticides, herbicides, fertilizers, cleaning chemicals, adhesives, epoxies, sealants, resins, concrete washout slurry, mortar, grout, drywall mud, asphalt or roofing tar, sewage, septic waste, animal waste, food waste in bulk, medical waste, biohazards, asbestos, lead paint chips, mercury-containing devices, refrigerants, batteries, and any other liquid, semi-liquid, hazardous, regulated, or environmentally damaging material.
Customer is fully and solely financially responsible for any and all costs associated with contamination of the dumpster, the delivery surface, the surrounding property, soil, groundwater, storm drains, the transporting truck, the landfill, or any third-party facility, including but not limited to: contamination cleanup, pressure washing, scrubbing, scraping, repainting, re-decaling, deodorizing, odor neutralization, sanitization, decontamination, environmental handling, transportation of contaminated material, disposal surcharges, landfill rejection fees, return-trip transportation, hazardous waste manifesting, regulatory reporting, environmental testing, soil remediation, third-party remediation services, labor (driver, yard, and remediation personnel), equipment damage related to contamination, downtime and loss of use of the dumpster and truck while out of service, administrative costs, environmental penalties, and any fines, penalties, citations, or enforcement actions assessed by any governmental, environmental, or regulatory authority.

- Environmental Remediation Charge — actual costs incurred for environmental cleanup, regulatory response, contamination mitigation, soil or groundwater remediation, storm-drain or waterway response, or third-party remediation services. No flat cap. Billed at actual cost.
These fees represent minimum, reasonable operational charges and are not penalties. All amounts described above are in addition to — and cumulative with — any other applicable fees under this agreement.
6b. Contamination Charge Authorization & Supporting Evidence
Customer expressly authorizes Dumpster Dogs to charge the payment method on file for any and all contamination, cleanup, hazardous material, remediation, environmental, regulatory, equipment-damage, and related costs described in Section 6a, in any combination, at the minimums stated and/or at actual cost, without obtaining further authorization for each individual charge. Multiple contamination categories may be charged separately and cumulatively on the same rental.
Customer agrees that Dumpster Dogs may rely on, retain, and present as supporting evidence for any contamination, cleanup, hazardous material, environmental, or remediation charge: photographs, videos, landfill reports, landfill rejection notices, scale tickets, inspection records, driver notes, GPS logs, delivery and pickup timestamps, electronic communications, environmental testing results, regulatory correspondence, and third-party remediation invoices. Such documentation may be used in support of billing, collections, chargeback responses, insurance claims, dispute resolution, regulatory response, and legal proceedings.
7. Damage to Dumpster & Financial Responsibility
Customer assumes full financial responsibility for any damage to the dumpster occurring during the rental period or while the dumpster is on the customer’s site, beyond normal wear and tear, regardless of cause.
This includes but is not limited to:
- Structural damage
- Side walls, floor, roofline, or rails
- Doors, hinges, latches, and locking mechanisms
- Casters, rollers, skids, wheels, or related components
- Hooklift points, pickup points, or lifting components
- Paint, decals, logos, wrap, branding, or graphics
- Fire, heat, chemical, or burn damage
- Damage caused by overloading, improper loading, heavy materials, equipment, vehicles, vandalism, unauthorized use, misuse, prohibited materials, or third-party actions
Customer agrees to pay the full cost to repair, repaint, re-decal, restore, or replace the dumpster or any damaged component so the dumpster is returned to its prior condition.
If repair is not feasible or if the dumpster is deemed unsafe or uneconomical to repair, Customer agrees to pay the full replacement cost of the dumpster.
Customer is responsible for loss of use of the dumpster during any period it is out of service due to damage.
If expedited repair or replacement is required to maintain business operations, Customer agrees to pay all reasonable costs associated with such expedited service, including but not limited to rush repair, replacement, transportation, labor, parts, equipment, administrative costs, and related operational expenses.
Customer acknowledges that these charges represent reimbursement for actual damages, operational losses, and reasonable costs, and are not a penalty.
8. Personal Injury & Third-Party Liability
The customer assumes sole responsibility for any and all personal injury, death, or property damage arising from the use, misuse, presence, loading, condition, or contents of the dumpster, except to the extent caused by Dumpster Dogs’ gross negligence or willful misconduct.
This responsibility includes injury, death, or property damage suffered by:
- The customer
- Employees, contractors, or agents of the customer
- Guests, tenants, or invitees
- Children or unauthorized persons
- Any third party who accesses, uses, enters, climbs on, or is near the dumpster, whether authorized or unauthorized
Customer agrees that Dumpster Dogs and Mann Hauling LLC shall have no liability for injuries or death resulting from the use or misuse of the dumpster, except to the extent caused by Dumpster Dogs’ gross negligence or willful misconduct.
9. Included Weight Limits
Each dumpster rental includes the following weight allowance:
- 16-yard dumpster: 2 tons / 4,000 pounds included
Any weight exceeding the included limit will be billed at $0.06 per pound ($120 per ton) over the included weight allowance.
All weights are determined by certified scale tickets from the disposal facility and are outside the control of Dumpster Dogs.
10. Overweight Loads & Unsafe Conditions
Dumpster Dogs reserves the right to refuse pickup of any dumpster that is overloaded, improperly loaded, filled above the top rail, unbalanced, unsafe to lift, unsafe to transport, or in violation of applicable transportation laws or safety requirements.
If a dumpster exceeds safe or legal lifting or hauling limits, the customer is responsible for all costs associated with load correction, third-party hauling, offloading, labor, transportation, disposal services, return trips, and any related expenses.
11. Overweight & Non-Compliant Loads
Customer is responsible for correcting any overweight, overfilled, above-rail, unbalanced, improperly loaded, or unsafe condition before pickup. Customer may be required to unload, remove, or relocate excess material before pickup can be completed.
If the customer fails or refuses to correct the condition:
- An Overfilled / Above Rail Fee of $95 per occurrence may be charged when debris extends above the top edge/rails of the dumpster. Overfilled dumpsters may be unsafe or illegal to transport; Dumpster Dogs reserves the right to refuse pickup until corrected.
- Extra Day charges of $15 per day will continue to accrue until the dumpster is made safe, compliant, accessible, and removed.
- A Failed Pickup / Service Fee (Trip Fee) of $95 per occurrence will be charged for each attempted pickup that cannot be completed.
- A Blocked Access Fee of $95 per occurrence may be charged where access is obstructed.
- Customer is responsible for all additional costs incurred, including but not limited to load correction, offloading, third-party hauling, additional labor, equipment, disposal, administrative costs, and transportation.
Customer acknowledges these charges represent reasonable operational costs, loss of use, and costs associated with unsafe or non-compliant loading conditions, are not a penalty, and may be charged cumulatively in addition to any other applicable fees under this agreement.
12. Heavy Materials & Equipment Damage
Certain materials such as concrete, brick, asphalt, dirt, stone, roofing shingles, and other dense materials can significantly increase dumpster weight and may exceed safe lifting or transport limits.
The customer agrees not to load the dumpster with excessive amounts of heavy materials that could make the container unsafe to transport or lift.
If a dumpster becomes overloaded or contains excessive heavy materials that cause damage to the dumpster, roll-off truck, hooklift system, hoist, cables, hydraulics, frame, suspension, tires, or any related equipment, the customer agrees to be financially responsible for all resulting damages.
These costs may include but are not limited to:
- Equipment repair costs
- Replacement parts
- Labor
- Towing or recovery services
- Transportation costs
- Loss of equipment use or downtime
- Expedited repair or replacement costs
Dumpster Dogs reserves the right to determine whether damage resulted from overloading or improper loading of the dumpster. All such costs may be charged to the payment method on file.
13. Failed Pickup / Trip Fees
A Failed Pickup / Service Fee (Trip Fee) of $95 per occurrence will be charged if a scheduled delivery, service, or pickup cannot be completed due to customer-related conditions, including but not limited to blocked access, locked gates, vehicles or equipment blocking the dumpster, overfilled dumpsters, overweight loads, unsafe loading, lack of required permits, refusal of removal, or failure to provide access at the scheduled time.
Customer acknowledges that this fee represents a reasonable estimate of costs incurred, including driver labor, fuel, equipment operation, scheduling disruption, administrative time, and lost service opportunity. This fee is not a penalty.
13a. Additional Fees & Charges
The following fees may apply in addition to the base rental rate:
- Extra Day Fee — $15/day: charged for each additional day the dumpster remains beyond the agreed rental period.
- Trip Fee — $95: charged if a scheduled delivery or pickup cannot be completed due to inaccessibility or other customer-related conditions. (Also referred to as the Failed Pickup / Service Fee.)
- Failed Pickup / Service Fee — $95: charged for each attempted pickup that cannot be completed due to customer-related conditions. Same fee category as the Trip Fee.
- Hazardous Material Handling Fee — $90 minimum per category, PLUS all actual disposal, transportation, remediation, environmental, regulatory, landfill, and third-party handling costs incurred.
- Contamination Cleanup Fee — starting at $150, plus actual cleanup/remediation costs incurred.

- Tire Disposal Fee — $25 per tire: charged for each tire discovered in the dumpster.
- Blocked Access Fee — $95 per occurrence: charged each time the dumpster cannot be accessed for delivery, service, or pickup due to obstructed access. Same $95 fee category as the Failed Pickup / Service Fee and Trip Fee.
- Sunday Delivery Fee — $200: Applied automatically when delivery is scheduled on a Sunday. Sunday pickups are not performed; rentals ending on a Sunday are picked up the following Monday at no extra charge.
- Same-Day Delivery — Free: Same-day delivery requests submitted before 3:00 PM local time carry no additional fee. Subject to truck and dumpster availability.
- After-Hours Rush Delivery Fee — $50 (flat): Applied to same-day delivery requests submitted after 3:00 PM local time and before 6:00 PM local time. Accepted only at Dumpster Dogs' sole discretion. Same-day delivery is NOT available after 6:00 PM local time.
- Mileage (tiered): First 15 miles included from our service yard. Beyond 15 miles, mileage is charged at $3.00/mi (15–25 mi), $4.00/mi (25–30 mi), and $8.00/mi (30–40 mi), one-way. Maximum service radius is 40 miles.
- Pricing & Weight: 16-yard rentals are $315 (3-day), $365 (5-day), or $405 (7-day), include 2 tons (4,000 lbs); overage billed at $0.06 per pound ($120 per ton) based on certified scale tickets.
- Material Restrictions: Concrete, dirt, brick, asphalt, stone, roofing shingles, and other dense materials are limited to small quantities unless specifically approved by Dumpster Dogs prior to loading.
- Overfilled / Above Rail Fee — $95 per occurrence: charged when debris or material extends above the top edge/rails of the dumpster. Overfilled dumpsters may be unsafe or illegal to transport; Dumpster Dogs reserves the right to refuse pickup until the load is brought below the rails. This fee may stack with Extra Day charges if pickup is delayed waiting for correction, and with Trip / Failed Pickup / Blocked Access Fees where applicable.
- Cancellation Fee — up to $75: Dumpster Dogs may apply a cancellation fee of up to $75 depending on timing and operational impact. No cancellation fee is charged automatically — each cancellation is reviewed and approved by Dumpster Dogs. Earlier cancellations may qualify for a partial or full refund at Dumpster Dogs' sole discretion. Cancellations within 24 hours of scheduled delivery may incur up to the full $75 fee, and some or all of the booking amount may become non-refundable. See Sections 25 and 26.
These fees represent reasonable estimates of operational costs and are not penalties. Customer authorizes Dumpster Dogs to charge any applicable fees to the payment method on file.
14. Rental Period & Extra Day Charges
Advertised 3-day, 5-day, and 7-day rentals are discounted package rates. The rental period begins on the date of delivery.
Any time beyond the agreed rental period will be charged at $15 per day (Extra Day Fee) until the dumpster is removed.
Customer acknowledges that the Extra Day rate represents a reasonable estimate of damages and costs, including loss of use, equipment availability, scheduling impact, and operational costs, and is not a penalty.
15. Overdue Rentals, Inaccessibility & Retrieval Rights
Once the rental period has expired, Dumpster Dogs reserves the right to schedule pickup at its discretion. Customer must ensure the dumpster remains accessible, compliant, safe, and unobstructed for pickup at all times.
Customer is responsible for maintaining or restoring safe and unobstructed access to the dumpster at all times.
If the dumpster becomes inaccessible due to any condition, whether within or outside of the customer’s direct control, including but not limited to weather, snow, ice, mud, flooding, third-party actions, vehicles, equipment, locked gates, blocked access, construction activity, site conditions, or unsafe ground conditions, the customer agrees to make all reasonable efforts to promptly restore access.
If the customer fails to take reasonable action to restore access within a reasonable timeframe, all applicable charges, including daily rental charges and failed pickup fees, will continue to apply.
If the dumpster is inaccessible, blocked, buried, frozen in place, overloaded, overfilled, unsafe to transport, or otherwise unavailable for pickup due to customer-related site conditions:
- Extra Day charges of $15 per day will continue to accrue until the dumpster is made accessible, compliant, safe, and removed.
- A Failed Pickup / Service Fee (Trip Fee) of $95 per occurrence will be charged for each attempted pickup that cannot be completed.
These charges are separate and cumulative. Customer acknowledges that the Extra Day Fee compensates Dumpster Dogs for continued equipment use and loss of availability, while the Failed Pickup / Service Fee (Trip Fee) compensates Dumpster Dogs for driver labor, fuel, equipment operation, scheduling disruption, and administrative costs associated with a failed service attempt. These charges are reasonable estimates of actual costs and are not penalties.
16. Access & Right of Retrieval
Customer grants Dumpster Dogs the right to enter the property at any reasonable time to deliver, inspect, service, or retrieve the dumpster.
Dumpster Dogs reserves the right to retrieve the dumpster at any time, with or without prior notice, particularly in cases of non-payment, safety concerns, abandonment, overdue rental, inaccessibility, prohibited materials, property owner request, or violation of this agreement.
Customer agrees not to interfere with Dumpster Dogs’ lawful retrieval of its equipment.
17. Abandonment
A dumpster will be considered abandoned if it remains overdue for more than 30 days without communication from the customer or without payment of amounts due.
Dumpster Dogs may take possession of the dumpster and pursue all available remedies, including recovery of the dumpster, collection of outstanding fees, legal costs, attorney’s fees, court costs, and any expenses associated with retrieval.
18. HOA & Municipal Compliance
The customer is solely responsible for compliance with all applicable homeowner association rules, city or county ordinances, zoning regulations, right-of-way restrictions, road restrictions, and permit requirements.
Any fines, penalties, towing, enforcement actions, or related costs resulting from non-compliance are the customer’s responsibility.

Any improper chargeback or payment dispute may result in additional administrative fees, collection action, and recovery of associated costs, including attorney’s fees and court costs where permitted by law.
20. Indemnification
The customer agrees to indemnify, defend, and hold harmless Dumpster Dogs, Mann Hauling LLC, and their respective owners, employees, agents, contractors, and representatives from any claims, damages, losses, liabilities, costs, or expenses, including attorney’s fees and court costs, arising out of or related to:

21. Documentation
The customer agrees that photographs, videos, scale tickets, GPS records, delivery records, pickup records, communication records, and other documentation may be used to document the condition of the dumpster, the delivery location, access conditions, contents, loading condition, property condition, and charges incurred.
Such documentation may be used by Dumpster Dogs in support of billing, collections, insurance claims, dispute resolution, or legal proceedings.
